Introduction

Welcome to CHK STRUCTURE AND SERVICE CO., LTD. Koh Samui Branch. These terms and conditions ("Terms") govern your use of our construction, maintenance, and villa care services in Koh Samui, Thailand. By accessing or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.

Service Description

We provide comprehensive home maintenance and construction services in Koh Samui, Thailand. Our services include but are not limited to:

  • General Maintenance: Regular upkeep and repair services for residential and commercial properties
  • Plumbing and Electrical Systems: Installation, repair, and maintenance of plumbing and electrical infrastructure
  • Structural and Construction Work: New construction, renovations, and structural repairs
  • Gardening and Landscaping: Garden maintenance, landscaping design, and outdoor space management
  • Air Conditioning Systems: Installation, maintenance, and repair of HVAC systems
  • 24/7 Emergency Services: Round-the-clock emergency response for urgent repairs and maintenance issues
  • Pool Maintenance: Regular cleaning, chemical balancing, and pool equipment maintenance
  • Villa Care Packages: Comprehensive monthly maintenance packages for vacation properties

Booking and Payment

3.1 Service Booking

Customers can book services through our website, phone (063-841-9593), Line (samuifix), or other channels we provide. A booking is considered confirmed when we receive payment or provide written confirmation. We reserve the right to refuse service requests that are outside our scope of work or pose safety concerns.

3.2 Payment Terms

Payment can be made through various channels we support, including cash, bank transfer, or other agreed-upon methods. Prices shown are starting prices and may vary based on the complexity of the work, materials required, and site conditions. A detailed quote will be provided before work commences for projects exceeding 5,000 THB.

3.3 Booking Cancellation

Customers can cancel bookings at least 24 hours in advance without cancellation fees. Cancellations within 24 hours may incur a cancellation fee of up to 50% of the quoted service price. Emergency service bookings are subject to different cancellation terms as outlined in our emergency service agreement.

3.4 Payment Schedule

For large projects, a deposit may be required before work commences. Final payment is due upon completion of work and customer satisfaction. We accept payment in Thai Baht (THB) only unless otherwise agreed in writing.

Warranty and Guarantee

We guarantee the quality of all our workmanship and materials. Warranty periods vary according to the type of work performed:

  • General Repairs and Maintenance: 30 days from completion date
  • System Installation (Plumbing, Electrical, HVAC): 90 days from installation date
  • Structural Work and Construction: 1 year from completion date
  • Pool Equipment and Systems: 60 days from installation or repair date
  • Landscaping and Garden Work: 30 days for plants, 90 days for hardscaping

Important Note: Warranty does not cover damage caused by misuse, failure to follow maintenance instructions, natural disasters, acts of God, or modifications made by third parties. Warranty claims must be reported within the warranty period and will be assessed on a case-by-case basis.

Liability and Insurance

We maintain appropriate insurance coverage for our operations. We are liable for damages directly caused by our negligence or faulty workmanship. However, we are not liable for damages caused by:

  • Misuse or improper use of completed work
  • Failure to follow maintenance instructions or recommendations
  • Natural disasters, extreme weather events, or acts of God
  • Third-party actions or modifications
  • Pre-existing conditions not disclosed before work commencement
  • Consequential or indirect damages

Our liability is limited to the value of the work performed or the cost of rectification, whichever is less. Customers are advised to maintain appropriate property insurance coverage.

Privacy and Data Protection

We are committed to protecting your privacy and personal information. Personal data collected through our services, website, or communications is used solely for:

  • Service delivery and scheduling
  • Communication regarding bookings and services
  • Billing and payment processing
  • Service improvement and customer support
  • Legal compliance and record-keeping

We will not sell, rent, or disclose your personal information to third parties without your explicit consent, except as required by law or for service delivery purposes (e.g., subcontractors with confidentiality agreements). We implement appropriate security measures to protect your data.

Dispute Resolution

In the event of any dispute or disagreement, we are committed to resolving issues fairly and promptly. Our dispute resolution process follows these steps:

  1. Direct Communication: Contact us directly to discuss the issue. We will respond within 48 hours.
  2. Mediation: If direct communication does not resolve the issue, we will engage in good faith mediation.
  3. Formal Complaint: Formal complaints should be submitted in writing with supporting documentation.
  4. Legal Recourse: If mediation fails, disputes will be subject to Thai law and the exclusive jurisdiction of Thai courts.

We encourage open communication and aim to resolve all issues amicably. Most disputes can be resolved through direct discussion.

Changes to Terms

We reserve the right to modify, update, or amend these terms and conditions at any time to reflect changes in our services, legal requirements, or business practices. Changes will be effective immediately upon posting on our website.

We will make reasonable efforts to notify customers of significant changes via email or website notice. However, it is your responsibility to review these terms periodically. Continued use of our services after changes are posted constitutes acceptance of the modified terms.
